In my opinion, everyone could benefit from the use of a living trust. However, are they absolutely necessary in all circumstances. No they are not. Living Trusts are best for individuals who like to plan for peace of mind. They are a great way of avoiding probate (click here for article describing probate).
In short, probate can be a very expensive process and could possibly cause some unintended results as a Judge could get involved. Further, a living trust describes exactly how settlement will occur and how to pay for it. Everyone should at a minimum receive an education on what a living trust is in order to make an educated decision for their personal estate plan.
